1. Introduction

(i) RottenDriver.com is an entertainment service owned and operated by Public Service Entertainment LLC ("PSE"), comprising a website at http://www.rottendriver.com and related services (the "Site").

(ii) A user of the Site (a "User") may report an incident of driving behavior that is, in the User's opinion, rotten (an "Incident") by sending an SMS text message containing a keyword and the vehicle license plate number (a "Report") to the Site according to our Terms of Use.

(iii) PSE appreciates the importance of your privacy as a user of our Site and, potentially, as a subject of a "rotten driving" Report. This privacy policy explains the types of information we obtain, how it is used and by whom.

(iv) PSE reserves the right to change all or a portion of this Privacy Policy at any time with or without individual notice to you, and your continued use of the Site constitutes your binding acceptance of any such changes. You may always review the most current version of our Privacy Policy on our website.

2. Personally Identifiable Information

(i) We may obtain name, postal and e-mail addresses, phone numbers and/or other personally identifiable information ("PII") from you when you create an account at the Site or use it in other ways.

3. Vehicle and Incident Descriptions

(i) We may receive Reports that include the license plate of your vehicle. We do not collect or store any information about the driver or registered owner of any vehicle. We do not communicate directly or indirectly with vehicle registries, government motor vehicle departments or other official or private agencies about any individual license plate, vehicle or driver.

(ii) We may publish license plate numbers on the Site along with the number of Reports received by each over various time periods.

(iii) Users who have submitted a Report may visit the Site and supply information about the Incident that was the subject of the Report, including make, color, style and other characteristics of the vehicle involved. We may publish a fictional representation of a vehicle based on these characteristics. When we do, the fictional representation will not include any information about the license plate or the User and will not uniquely identify any vehicle.

(iv) We may publish statistical summary information based on vehicle characteristics. This information does not identify individual vehicles, license plates, or Users.

4. Other Information We May Obtain

(i) PSE may conduct surveys or polls among users regarding the Site. We will not share the results obtained from the surveys and polls with anyone.

(ii) We receive information automatically about how the Site used, including browser type and version information, referring and exit pages, and other information commonly found in log files written by web server software. We will not link this data to your personal information and we will not disclose or share it.

(iii) RottenDriver.com is an entertainment service. We do not share information about Reports with police departments or other law enforcement agencies except when required to do so, as described in the Legal Disclaimer section of this Privacy Policy. More information about permitted uses of the Site is available in our Terms of Use.

5. How Information May Be Shared

(i) We may share aggregate information about our users with advertisers, vendors or other business partners. This information will not be traceable to any individual User of our Site.

(ii) We will not share or otherwise disclose information about license plates reported to the Site beyond publishing the plate and the number of reports it received in a given time interval on the Site.

(iii) We will not publish, share or otherwise disclose any information about who submitted a report, except as described in the "Legal Disclaimer" section below.

6. Legal Disclaimer

(i) We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on us.

7. Communications From Us

(i) If you create and account at the Site, we send a confirmation email to the address you provide. We may also send you announcements about changes to our service.

(ii) If you have configured your Account at the Site to send email alerts, we will send emails to the address on your Account when certain license plates are reported. You may choose which plates can result in email alerts by logging in and making the appropriate changes to your watch list on the Site.

8. Our Use of Cookies

(i) Cookies are small data files sent from a website to your browser, which stores them in memory or on the hard drive of your computer. Cookies from our Site do not read information stored anywhere on your computer or cookies sent from other websites.

(ii) The Site may use cookies to store information obtained from you about your current and past use of the Site, including but not limited to your preferences about the features and behavior of the Site, and whether you are logged-in. We do not store any personal information in cookies.

(iii) Third-party advertisers on the Site may employ cookies or other means to evaluate traffic and other usage of their ads or other content that may appear on the Site. Their use of such information is controlled by the Privacy Policies (if any) of such third parties, and not PSE. Accordingly, PSE has no responsibility or liability for these independent policies or the actions of such third parties.

9. Security

(i) We use security systems and procedures to protect your personal information that is retained by us. However, because of the dynamic nature of the internet technology and consequential vulnerabilities, PSE cannot guarantee absolute or unqualified protection of this information.

(ii) Accordingly, PSE makes no representations or warranties as to the effectiveness of its security and assumes no liability for security breaches made possible by any failure in its security systems or procedures, or any failure in the security of your computer equipment, your ISP or other networks and communications providers.
